What is a resale certificate?
A Florida Annual Resale Certificate for Sales Tax allows a registered business to purchase qualifying merchandise tax-free when it is genuinely buying that merchandise to resell. It is not a general exemption from sales tax and not a license to buy things for personal use without tax.
How do you get one in Florida?
- Determine your sales-tax obligations. If your business will make taxable sales in Florida, register as a sales-and-use-tax dealer with the Florida Department of Revenue.
- Complete the state registration. Use the Florida Department of Revenue registration resources; the state also offers Form DR-1.
- Receive your documents. After approval, eligible registered dealers receive a Certificate of Registration (DR-11) and an Annual Resale Certificate (DR-13).
- Save your current certificate. You can print your certificate through the Department’s official certificate portal.
How do you actually use it?
When purchasing inventory to resell, provide the supplier with a current resale certificate or follow the supplier’s resale-documentation procedure. Sellers must properly document qualifying tax-exempt resale transactions. Keep your own accurate purchasing and sales records.
Example: Buying a pallet of tools to resell individually may qualify. Buying tools to furnish your own workshop or items for your household does not qualify merely because you run a resale business.
Does a resale certificate mean you never collect sales tax?
No. The certificate generally addresses qualifying purchases made for resale. When you later sell taxable goods to your customers, you may have sales-tax collection and reporting obligations. Some marketplace transactions have different collection arrangements; confirm the rules that apply to your sales channels.
Does it expire?
Yes. Florida Annual Resale Certificates expire December 31 each year. Active registered dealers receive a new certificate annually; make sure you present a current one.
Common mistakes to avoid
- Using a certificate to buy equipment or supplies for your own business rather than for resale.
- Assuming it removes the need to file or remit sales tax.
- Using an expired certificate.
- Confusing a resale certificate with a general business license.
